Northwest Florida Rental Policies & Procedures
Advanced Deposits
For reservations less than twenty-eight (28) days in length an advance deposit equal to one (1) night rent, taxes and fees is required per unit at the time of booking. The advance payment will be applied toward the total rent, taxes and fees due. Full payment is due upon arrival. Monthly reservations of twenty-eight (28) days or longer require a fully refundable security deposit of $200 due at the time of booking. Payment for each monthly period is due in full on the first day of that month.Travelers checks, money orders, cashiers checks, cash, personal
checks and credit cards (Visa, Master Card, Discover and American Express) will
be accepted for payments.

Reservation Fee
Each reservation includes a 3.2% reservation fee calculated on the total value of each reservation folio. This reservation fee is non-refundable and will appear as a separate line item on each reservation folio. This reservation fee is not charged to extended stay rentals (rentals over twenty-eight (28) days).

Reservation Cancellation & Change Policy
Reservations less than twenty-eight (28) days in length require a fourteen (14) day cancellation or change notice. Cancellations and changes that are made more than fourteen (14) days prior to the check-in date will result in the refund of the advance deposit less a $40 cancellation fee. Cancellations and changes that are made within fourteen (14) days of the check-in date will forfeit one (1) night rent, taxes and fees. Monthly reservations of twenty-eight (28) days or longer require a one hundred twenty (120) day cancellation or change notice. Cancellations and changes that are made more than one hundred twenty (120) days prior to the check-in date will result in the refund of the security deposit less a $40 cancellation fee. Cancellations and changes that are made within one hundred twenty (120) days of the check-in date forfeit the full security deposit.
Upon check-in, guests are required to confirm departure dates. Should a guest decide to leave earlier, the guest may be charged an early departure fee. Reservations that are considered “No Shows” will result in full forfeiture of the advance deposit, which will be the equivalent of one (1) night rent, taxes, and fees or the security deposit depending on the length of the reservation.

Check-In & Check-Out Times
Check-in time will begin after 4:00 p.m. Due to our high housekeeping standards, not all units will be available for check-in at 4:00 p.m. This is especially true during peak seasons. Check-out time is at 10:00 a.m. Late check-outs may be arranged only on the date of departure and are strictly based on availability. Late check-outs will incur additional charges.

Hurricane Policy
Refunds will not be processed unless the National Weather Service/NOAA has issued a Hurricane Warning for the immediate area in which the property is located. Waterstone Resorts will process refunds for reservation dates that correspond to the dates of the NOAA issued hurricane warning.

Age Requirements
Singles under the age of twenty-five (25) are prohibited from booking unless accompanied by a parent or legal guardian. There may be additional restrictions regarding the number of people that may accompany a parent or legal guardian. Age will be verified upon check-in.

Falsified Reservations
Any reservation obtained under false pretense will be subject to full forfeiture of advance deposit or security deposit payment(s), and the party will not be permitted to check in. If the party has already checked in, occupants may be required to vacate the property immediately with full forfeiture of all reservation payments.

Non-Smoking Accommodations
Smoking is not permitted in any Waterstone Resorts vacation accommodation.

Pet Policy
Pets are not permitted in any Waterstone Resorts vacation accommodation.

Minimum Reservation Requirements
All properties require a three (3) night minimum reservation. Longer reservations
may be required during peak seasons and/or holidays. Weekly reservations may
be required for some properties during peak seasons and/or holidays.

Occupancy Requirements
The maximum number of guests per condominium unit is limited at all properties and is based on the unit type. If the maximum occupancy is exceeded, the guests may be asked to vacate the property and will be subject to forfeiture of advance deposit and reservation payment(s).

Housekeeping
Reservation rates include a full housekeeping departure clean. Additional housekeeping services may be available for purchase upon check-in. We ask that all towels and linens remain in each unit at all times. We suggest that guests bring personal beach towels for use outside of the rental unit.

Reservation Payment Requirements
All outstanding balances are due upon check-in. Reservation payments, with proper identification, may be made in the form of travelers checks, money orders, cashiers checks, cash, personal checks, and credit cards (Visa, Master Card, Discover, and American Express).

Parking
All properties prohibit on-site parking of recreational vehicles, trailers and watercraft. All properties restrict the number of vehicles per rental unit. All vehicles must be registered with the front desk to obtain a parking permit. Vehicles that do not display a parking permit are subject to towing at the owner’s expense.

Southwest Florida Rental Policies & Procedures
Age Requirements
The individual making the reservation must be 25 years of age or older and must occupy the rental property the entire term of the reservation. Singles under 25 years of age are prohibited unless accompanied by a parent or legal guardian. Additional restrictions may apply during the spring break vacation period. Chaperoned groups are prohibited.

Agents Right of Entry
Waterstone Resorts, or its assigns, may enter residence during regular business hours for the normal management of residence with a 24-hour notice to the guest. Waterstone Resorts or its assigns may also enter the residence to show a property listed for sale. In case of emergency, Waterstone Resorts may enter the residence at any time.

Cancellation Policy
For Bonita Springs & Beach, Ft. Myers Beach and Kelly Green: Cancellation during any time period will always result in a loss of the 5% reservation fee. Cancellation before final payment will result in a loss of 10% of the deposit, plus the 5% reservation fee. The damage waiver fee is refundable along with a portion of rent depending on date of cancellation if cancelled prior to final payment requirement. Cancellation after final payment will result in a loss of 100% of the entire rent for the stay, plus 5% reservation fee, cleaning fee, and damage waiver.
Check – In Time
Check in time is after 4:00 P.M. If you anticipate your arrival to be after 5:00 P.M., Monday through Friday, or if you are arriving on Saturday or Sunday, please call our office to make arrangements for check-ins. Your Check-in LOCATION information is enclosed.
Check –Out time
Check out time is at 11:00A.M. (10:00A.M. in some locations. Please review your confirmation for exact times.)

Damage Waiver
A damage waiver is required in addition to the rental rate and reservation fee. This damage waiver is $25 for each stay of two-three (2-3) days and $50 for each stay of four (4) days or longer, and plus applicable tax. This damage waiver fee covers up to $2,500 in reported accidental damages. Guest must report damage before time of departure.

Deposit Guarantee
All reservations require a deposit and a reservation fee at time of booking paid by credit card (with the exception of Wholesale and Groups) Waterstone Resorts accepts Visa, MasterCard, and American Express (Discover accepted only in certain locations).
In cases of payment by check, all funds shall be made payable to Waterstone Resorts, LLC with a notation of your folio number written on your check. Receipt of your deposit indicates acceptance of this reservation confirmation agreement and all the terms and conditions contained herein. Deposit amounts will vary depending on type of property and length of stay.

Full Payment Due
Final payment is due thirty (30) days prior to arrival for condominiums and villas, sixty (60) days prior to arrival for free standing homes, or day of arrival for resorts (depending on length of stay). If reservation is made within thirty (30) days prior to arrival for condominiums and villas, within in sixty (60) prior to arrival for homes, or upon arrival for resorts, 100% of payment (including booking fee, damage waiver, applicable cleaning fee and taxes) is due at time of booking. Final payment is nonrefundable unless stay is rebooked (incurring 10% loss of rent rebooking fee plus reservation fee). Failure to make any payment in a timely manner may result in the cancellation of your reservation and forfeiture of any funds on deposit. Refunds or adjustments cannot be made for late arrival or early departure. Final payment includes damage waiver (if applicable) and taxes. In cases of payment by check, all funds shall be made payable to WATERSTONE RESORTS LLC, with a notation of your folio number written on your check.

Indemnification of Agent by Guest
Waterstone Resorts shall not be liable to guest or to any other party for damages to property or for the injury to persons upon the premises from any cause whatsoever including defects in the premises or otherwise. Guest shall indemnify and hold harmless Watestone Resorts from and against all liabilities, claims, expenses, fees, loss of use and actions of any kind arising out of guest’s use and occupancy of the premises.

Linens & Terry
While this residence conforms to the minimum furnishings requirements of WATERSTONE RESORTS, all residence are owned, decorated, and furnished by the individual Owner. Neither WATERSTONER RESORTS, nor the Owner shall be responsible for providing any additional furnishings or equipment not available and not presently existing in the unit at the time the reservation is made. All other items shall be the sole responsibility of the guest.
Occupancy
Guest agrees to keep the maximum number of people occupying the premises at/or under the maximum persons allowable. Any breech of the above policies will result in termination of this agreement including possible eviction of the property and possible forfeiture of any monies paid.

Payment Options
Waterstone Resorts accepts Visa, MasterCard, and American Express (Discover accepted only in certain locations). In cases of payment by check, all funds shall be made payable to Waterstone Resorts, LLC with a notation of your folio number written on your check.

Pet Policy
Sorry, no pets allowed unless an addendum is attached hereto. Any breech of this policy will result in termination of this agreement including possible eviction of the property and possible forfeiture of any monies paid.

Pools and Hot Tubs
Any pool located at an individual home that has pool heating facilities will have an additional utilities charge for heating the pool, including all applicable sales tax. The charges shall be prorated and billed to your credit card on file with us after receipt of the utility company invoice. Association or community pools heating (if applicable) are not the responsibility of guest nor Waterstone Resorts.

Property Rules
You hereby acknowledge that you will not be entitled to any refund for any inoperable appliances, to include by way of example only, television, air conditioner, hot tub, or pool. The agent agrees that upon notification by you of any malfunction Agent shall make every reasonable effort to have such appliance or item promptly repaired. If applicable, this agreement is subject to the approval, rules and regulations of the subject property Association, of which the owner is a member. Guest agrees to all Association rules and regulations, and to pay fees applicable for approval. If Association does not accept or approve guest, this agreement shall be cancelled, and all rental monies shall be refunded.

Rate Change
Rates are subjected to change with out notice.

Rates
For Bonita Springs & Beach, Ft. Myers Beach and Kelly Green: In addition to the rental rate, a 5% non-refundable reservation fee per transaction is calculated on the rental rate (does not include damage waiver or taxes). This 5% fee is charged for each separate stay, even if multiple stays booked. There is a minimum of $20 and a Maximum of $125 plus tax. The reservation fee is a flat $75 plus applicable tax for stays 27 nights or longer.

Substitution
In certain circumstances beyond our control, (i.e. fire, hurricane, sale, of unit, etc.) your confirmed property may be unavailable upon your arrival to WATERSTONE RESORTS reserves the right to substitute your accommodations. We cannot guarantee the confirmed rate in these instances. Although we will do everything possible to create a pleasant vacation experience, neither WATERSTONE RESORTS nor the owner are liable for damages or inconvenience in this rare and unusual situation.

Telephone Use
Local service is provided at no charge. Rental units are equipped with a non – proprietary calling system that allows you to charge long distance service to the calling/credit card of your choice. All charges for circumventing this system will be charged to your credit card.

Terms and Conditions
Keys: All keys, access cards, and garage or gate openers that have been provided to the Guest must be returned to the Check-In office upon departure. If Guest fails to return these items, a $25.00 retrieval will be charged to your credit card.
Valuables: Management or Owner is not responsible for the loss of valuables.
Waiver of terms: No waiver or any breach of any of the terms of this agreement shall be permitted.
Governing Law: This agreement shall be governed and enforced according to the laws of the state of Florida. The prevailing party in any lawsuit to enforce any provisions of this agreement shall be entitled to an award of attorney fees, cost and expenses for mediation, arbitration and trial or appellate proceedings.
Entire Agreement: This agreement contains the entire agreement of the parties. It may not be changed orally, but only by an agreement in writing signed by the party against who enforcement of any waiver, change, modification, extension, or discharge is sought. Guest cannot assign or transfer this Agreement.
On-line Booking & Information: The information provided on-line, although deemed accurate, is not guaranteed, and may be subject to errors, omissions, change of price, or withdrawal without notice.
